Dear Mr. Smith:
This is in follow-up to our telephone conversation yesterday regarding the materials
you forwarded to me last month.
While it does appear that some of the terms of the contract between your company
and China Eagle Co., Ltd. may have been breached, in my opinion, this alone would
not justify filing a contingent-fee lawsuit unless (a) the amount of quantifiable and
reasonably certain damages is sufficient to warrant the expenditure of resources
necessary to prosecute the action, and (b) the responsible party has the resources to
pay a judgment.
From what you told me on the phone, it does not appear that the damage amounts are
substantial or provable, and I therefore will not be able to represent you in this matter
unless you are able to provide additional facts substantiating and quantifying your
damages. This is only my opinion; other attorneys might reach different
conclusions. My unwillingness to take this case without further documentation and
information does not mean you do not have a case—only that I am not able to
undertake it on a contingent-fee basis.
I have not reviewed or analyzed your documents for the purposes of determining what
country’s law would apply or where suit should be filed. Nor have I attempted to
make a determination about when the statute of limitations would expire in this
matter, or whether it has already expired. If you wish to pursue this matter, you
should either seek other counsel or provide me with detailed support for a claim of
monetary harm as soon as possible, because your right to file suit will expire with the
passage of time, if it has not already.
